Welcome to SuperImages! These Terms of Service ("Terms") constitute a legally binding agreement between you and SuperImages Inc. ("we", "us", or "SuperImages") governing your access to and use of the superimages.app website and related services (collectively, the "Service").

1. Acceptance of Terms

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

SuperImages is an AI-powered image generation and editing platform. We provide:

• Text-to-image generation
• Image-to-image editing
• Avatar generation
• Other AI image processing tools

The specific features of the Service may be updated or changed from time to time without prior notice.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, complete, and current registration information
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use

You must be at least 18 years old or the age of legal majority in your jurisdiction to use our Service.

4. Paid Services and Subscriptions

4.1 Pricing

We offer both free and paid services. Paid services include but are not limited to:

• Credit pack purchases (one-time payment)
• Pro subscription service (monthly subscription)

All prices are displayed in US Dollars (USD) and may change at any time. Price changes will not affect services you have already purchased.

4.2 Payment Processing

All payments are processed through Stripe. By making a purchase, you agree to comply with Stripe's Terms of Service. We do not store your complete credit card information.

4.3 Automatic Renewal

Subscription services will automatically renew unless you cancel before the end of the current billing cycle. Renewals will be charged automatically using the payment method on file in your account.

4.4 Cancellation Policy

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle, and you will continue to have access to the service until that time. No refunds will be issued for the current billing period upon cancellation.

4.5 Refund Policy

Due to the nature of digital services:

• Credit pack purchases are non-refundable (whether used or unused)
• Subscription fees are generally non-refundable
• In exceptional circumstances, we may provide refunds at our discretion (e.g., technical failures preventing service use)

5. Usage Restrictions and Prohibited Conduct

You agree not to:

• Generate illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Generate content that infringes upon others' intellectual property rights
• Generate pornographic, violent, or hate speech-related content
• Use the Service for any illegal purpose
• Attempt unauthorized access to our systems or networks
• Interfere with or disrupt the operation of the Service
• Use automated tools (bots, scrapers, etc.) to access the Service without prior written permission
• Circumvent any technical limitations or rate limits

Violation of these rules may result in suspension or termination of your account without refund.

6. Intellectual Property

6.1 Your Content

You retain all rights to content you upload to the Service. By using our Service to generate images, you grant us a license to use, store, and process this content to provide the Service.

6.2 Generated Content

For images generated using our Service:

• Free users: Generated images may be used to improve our Service
• Paid users: You have commercial usage rights to generated images

Please note that AI-generated content may not be protected by copyright in some jurisdictions. You should evaluate and assume the risks of use at your own discretion.

6.3 Our Intellectual Property

The Service itself, and all its content, features, and functionality (including but not limited to information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SuperImages Inc. and are protected by international copyright, trademark, patent, and other intellectual property laws.

7. Disclaimers

The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The servers are free of viruses or other harmful components
• The accuracy, quality, or suitability of generated content

8. Limitation of Liability

In no event shall SuperImages Inc., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data loss, loss of use, or other intangible losses, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim, or $100 USD, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless SuperImages Inc. and its affiliates, officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third-party rights, including but not limited to any copyright, property, or privacy rights

10. Service Changes and Termination

We reserve the right to modify, suspend, or terminate the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or termination of the Service.

We may terminate or suspend your account for any reason, including but not limited to your violation of these Terms. Upon account termination, your right to use the Service will immediately cease.

11. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any disputes arising from these Terms or the Service shall first be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to the courts of competent jurisdiction in California.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SuperImages Inc. regarding the Service.

12.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such rights.

12.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Service. Changes are effective immediately upon posting.

Your continued use of the Service after the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, please stop using the Service.
